Terms of Service

These Terms of Service govern your use of the photography, videography, and related services provided by Forged In Frames. By engaging our services or using our website, you agree to be bound by these terms. Please read them carefully before making a booking.

01. Services Provided

Forged In Frames ("we," "us," or "our") provides professional photography, videography, aerial/drone media, and content creation services (collectively, "Services"). By engaging our Services, you ("Client") agree to be bound by these Terms of Service. All Services are provided on an appointment basis and are subject to availability. The specific scope, deliverables, timeline, and fees for each project shall be outlined in a separate Service Agreement or Proposal provided to the Client. We reserve the right to refuse service to any person or entity for any reason.

02. Intellectual Property

Licence: Upon full payment, the Client receives a licence to use the final delivered media for personal or commercial purposes as specified in the Service Agreement. Forged In Frames retains all copyright and intellectual property rights to all photographs, videos, and other media created unless otherwise explicitly agreed in writing. Portfolio Use: Forged In Frames reserves the right to use any photographs or videos created for display, portfolio, website, and marketing purposes unless the Client specifically opts out in writing prior to the project. Client Materials: Any materials provided by the Client (logos, assets, etc.) remain the property of the Client. No Unauthorised Reproduction: Clients may not reproduce, sell, licence, or distribute the deliverables without express written permission from Forged In Frames, except as explicitly stated in the Service Agreement.

03. Client Obligations

As a condition of using our Services, the Client agrees to: - Provide accurate, current, and complete information during the booking process and project consultation - Obtain all necessary permissions, releases, and licences for any materials provided to us - Ensure the safety and accessibility of shoot locations - Communicate any changes, cancellations, or special requirements in a timely manner - Be present and prepared at scheduled shoot times Failure to meet these obligations may result in project delays, additional fees, or cancellation.

04. Payment Terms

Payment Schedule: - One-third (1/3) booking fee (non-refundable) to secure the booking - One-third (1/3) due upon completion of the shoot - Final balance due before release of final media - All fees are quoted in GBP - We accept payment via credit card, bank transfer, or as otherwise agreed in writing Cancellation Policy: - Cancellations made more than 14 days before the scheduled shoot: booking fee is forfeited but no additional fees apply - Cancellations made within 14 days of the shoot: the full project fee may be charged - All cancellations must be submitted in writing via email Rescheduling: - The Client may reschedule once without penalty if notice is given at least 48 hours prior to the scheduled start time - Rescheduling within 48 hours may incur a fee Weather: - Drone and outdoor shoots may require rescheduling due to adverse weather conditions at no additional cost - We reserve the right to reschedule due to extreme weather conditions with reasonable notice

05. Limitation of Liability

To the maximum extent permitted by applicable law: - Forged In Frames shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with our Services - Our total liability for any claim arising from our Services shall not exceed the total fees paid by the Client for the specific project giving rise to the claim - We are not liable for: • Acts of God, weather conditions, or events beyond our reasonable control • Equipment failure not caused by our negligence • Dissatisfaction with creative direction or artistic interpretation • Third-party services or products used in conjunction with our Services - The Client agrees to indemnify and hold Forged In Frames harmless from any claims arising from the Client's breach of these Terms or violation of any law

06. Missed Appointments

- If the Client is more than 30 minutes late without prior communication, we reserve the right to treat the appointment as a no-show - No-shows are subject to the full project fee and no rescheduling is guaranteed - We reserve the right to reschedule due to illness, equipment issues, or extreme weather conditions with reasonable notice

07. Confidentiality

- We will treat all Client information as confidential and will not disclose it to third parties except as necessary to perform our Services or as required by law - The Client agrees not to share our proprietary workflows, pricing models, or trade secrets with competitors - Upon request, we will enter into a separate Non-Disclosure Agreement (NDA) for sensitive projects This confidentiality obligation survives the termination of the Service Agreement.

08. Changes to Terms

- We reserve the right to modify these Terms of Service at any time - Changes will be effective immediately upon posting to our website - Continued use of our Services after any modifications indicates acceptance of the updated terms These Terms of Service constitute the entire agreement between the Client and Forged In Frames regarding our Services and supersede any prior agreements or understandings.

09. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law provisions. Any disputes arising from these Terms or our Services shall first be attempted to be resolved through good-faith negotiations between the parties. If negotiation fails, disputes shall be resolved through the courts of England and Wales. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
